This deposit acts as my\nauthorization for Rockbridge to start building my website \/ or\nproviding project support and provisioning servers which will take\nplace immediately once payment clears. The balance will be paid upon\ncompletion of the website or service quoted. No website or service will\nbe\nstarted prior to receipt of this deposit. It must already exist PRIOR to\nthe start of any website development. \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EIt is purchased\nby an authorized Website Hosting Provider and is required prior to\ncommencing work.\u003C\/span\u003E \u003Cstrong\u003E Invoicing\nfor hosting occurs between customer and the hosting company directly. You are free to change passwords after installation.\nHosting and Domain Name registration guidace can be found at the link\nin Addendun D.\u00a0 If you purchase an ongoing support agreement\nfrom us after we install your website, we will\nrequire this same access to support you in the event you don't have\nknowlege\nof website server configurations, updates or on technical conversations\nwith your hosting company. \u00a0These services are NOT part of\nyour website design but are covered under a Website Support Agreement\nfrom\nRockbridge after installation if you choose to purchase one. Rockbridge agrees to assist customer in finding sources of\npublic domain images for use if the customer has no images of their own\nto use for their website. Rockbridge also agrees to assist in limited\nheader design. However this service is limited to editing images that\neither the client provides Rockbridge in advance of the project or the\nclient locates and selects from public domain sources during the\nproject. (See Graphics Design Resources below). Rockbridge will also\ninstruct the customer on how to create and edit text as part of the two\nhour training included in all our website design packages and projects.\nThe use of MS WORD or SIMPLE EMAIL TEXT is preferred for providing us\ntext content for use on pages articles. Customer is responsible as well\nfor the creation of any \u0022articles or blog posts\u0022. Rockbridge agrees to\nguide customer in their image selection process however Rockbridge\nitself cannot and will not be responsible for creating or editing any\nimage or text unless it is first selected, pre-approved, and provided\nby the customer. Rockbridge reserves the right not publish any image,\narticle or text it deems as objectionable or illegal. See custom image\nrestrictions below are to protect both the client and Rockbridge.\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003E\u003Cstrong\u003E\n\u003C\/strong\u003E\u003C\/span\u003E\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ECUSTOM HEADER\nIMAGES, LOGOs and CUSTOM GRAPHIC IMAGE DESIGN \/ COPYRIGHT INFRINGEMENT\u003C\/span\u003E:\n\u003C\/strong\u003E\u003Cstrong\u003E\nI understand and agree\u003C\/strong\u003E that\ngraphics design for new custom logos, headers or content images must\neither be provided to Rockbridge from either, me the customer, a\ngraphics designer retained by me the customer, or modified from\nRockbridge's existing image design set located within the image\ndirectory of our design theme file set. Rockbridge will be free to\nmanipulate any of these existing images however limited only to\nresizing, cropping, adding textual overlay. A maximum of two draft\nproofs will be provided to the customer. Additional advanced customer\ngraphics design work, photography, \u0022photo-shopping enhancements\u0022 are\nNOT covered under this website design agreement. \u003Cstrong\u003ESpecialized\ncustom graphics design, if required or requested of Rockbridge must be\nquoted separately\u003C\/strong\u003E. \u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ECOPYRIGHT\nINFRINGEMENT DISCLOSURE\u003C\/span\u003E:\u003C\/strong\u003E\nThe customer bears full responsibility for any image or text the\ncustomer provides to Rockbridge for insertion into their website with\nrespect to copyright infringement. Rockbridge will do its best to\ncounsel client on potential copyright restrictions where we feel there\nmay be a potential conflict, however customer agrees and understands\nthat Rockbridge itself does not provide any legal service with respect\nto copyright law, and as such assumes no responsibility, warranty or\nliability for any copyright violation. Rockbridge reserves the right to\nrefuse to use any questionable image or text in this regard. If in\ndoubt, we can refer you to a copyright attorney. \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003E\u003Cstrong\u003E\n\u003C\/strong\u003E\u003C\/span\u003E\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ESTANDARD GRAPHICS\nDESIGN RESOURCES\u003C\/span\u003E: \u003C\/strong\u003E\nRockbridge Services does provide basic, limited existing customer image\nmodifications (limited only to resizing, cropping, and the addition of\nNEW text to an existing image). Images provided to Rockbridge must be\nin .jpg .png and .gif format and either 1.) owned by the customer, 2.)\nowned by Rockbridge existing inside the customer selected design\ntheme's image directory or 3.) the image currently exists within the\npublic domain (i.e. non copyrighted images found on Google Images\nwebsite) and is selected by the customer for use in their website. We\nare not a graphics design company and do not specializing in new logo\nor custom banner \/ header design however we can make some modifications\nfor you as part of development at no additional charge to an existing\nimage you select in the public domain or provide to us which you\ncreated or own. Be sure to discuss this with us prior to contracting\nwith us to determine if your needs require an advanced graphic\ndesigner. \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ECustomers are\nresponsible for providing all images and text content to Rockbridge to\nadd to their website aside from the stock images in the custom themes\nowned by Rockbridge and our authorized reseller partners.\u003C\/span\u003E\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ECUSTOM GRAPHICS\nDESIGN SERVICES\u003C\/span\u003E:\u003C\/strong\u003E\nThe CUSTOMER may, in some circumstances desire to retain us \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003Eat an additional\ncost\u003C\/span\u003E for more extensive\ncustomized image development for such items as: newly designed logos,\nheaders, digital photography etc. Rockbridge may in such cases quote\nNEW DESIGN work and subcontract such work, or portions of work, or\nrecommend an advanced graphic designer of our choosing depending on\ncomplexity requested. \u003Cstrong\u003EIn\nall such cases Rockbridge will provide a separate estimate for any\nspecialized custom image design and it must be approved and accepted by\nthe customer prior to the start of the project. In all cases such\ncustom design work, if requested directly of Rockbridge, is limited to\nthree (3) initial design proofs after which Rockbridge must be\ncompensated at prevailing time and materials labor rates for additional\ngraphics design work. Rockbridge also reserves the right to reject any\nCUSTOM graphic image design project beyond that of simple image\nediting, cropping, resizing, text removal and new text overlay editing\nassuming the image permits it. \u0022Photo-shopping\u0022 images is NOT included\nin any website design package or service we provide directly.\u003C\/strong\u003E\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EGRAPHIC DESIGNER\nLOCATION ASSISTANCE\u003C\/span\u003E:\u003C\/strong\u003E\nRockbridge will, upon request, provide customers various on-line\nsources for images and business referral contacts for any advanced\ncustom graphic design services, digital photography, photo-shopping,\nand video production needs. These services are not services which\nRockbridge provides directly to the customer but their content may be\nembedded if it is part of the website design specifications purchased (\ni.e. embedded video capability). In all cases, Rockbridge cannot and\nwill not be responsible for subcontracting any creation of images,\nphotos or video without the prior consent and approval of the customer.\nAn estimate for any such additional subcontracted work will be provided\nto the customer from Rockbridge in advance of starting any graphics\ndesign sub-project. We encourage customers to work with these\nprofessionals directly. \u003Cstrong\u003E\nAny such subcontracting will be at additional customer expense.\u003C\/strong\u003E\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EDOMAIN NAMES \/\nWEBSITE HOSTING \/ EMAIL\u003C\/span\u003E: \u003C\/strong\u003E\nI understand that I must purchase a Domain Name, Website Hosting (with\nor without Email services) PRIOR to website design from a reliable\nHosting vendor. These servers are REQUIRED for any website from any\ndesigner.\u00a0 Rockbridge can help you in choosing a reliable\nhosting service. \u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EBROWSER TESTING\u003C\/span\u003E\u003C\/strong\u003E\n\u2013 Rockbridge will test the website in current versions of\nmajor desktop browsers including those made by Apple (Safari), Google\n(Chrome), Microsoft (Edge), Mozilla Firefox and Opera. We\u2019ll\nalso test to ensure that people who use Microsoft Internet Explorer 11\nfor Windows get an appropriate experience. We won\u2019t test in\nother older browsers unless we agreed separately. If you need an\nenhanced design for an older browser, we can provide a separate\nestimate for that.\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EMOBILE BROWSER\nTESTING\u003C\/span\u003E\u003C\/strong\u003E\n\u2013 Rockbridge will test the responsive design\/layout for\nmobile browser functionality. Testing using popular smaller screen\ndevices is essential in ensuring that a person\u2019s experience\nof the design is appropriate to the capabilities of the device\nthey\u2019re using. We test our designs in:\u003Cbr\u003E\niOS: Safari, Google Chrome\u003Cbr\u003E\nAndroid: Google Chrome on Android Emulator\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EINTELLECTUAL\nPROPERTY\u003C\/span\u003E\u003C\/strong\u003E\n- Customer will own all intellectual property rights of text, images,\nsite specification and data you provided unless someone else owns them.\nRockbridge will provide the source files, finished files, theme and\nplug-in licensing details. Rockbridge will own any intellectual\nproperty rights we\u2019ve developed prior to, or developed\nseparately from this project and not paid for by you. We\u2019ll\nown the unique combination of these elements that constitute a complete\ndesign, and we\u2019ll license its use to you, exclusively and in\nperpetuity for this project only, unless we agree otherwise.\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ELIMITED REFUND\nPOLICY\u003C\/span\u003E: \u003C\/strong\u003E\u003Cbr\u003E\n\u003Cstrong\u003EI understand and agree \u003C\/strong\u003Ethat\nall websites and custom projects require a set up and design fee with a\nlimited 30 day refund. (See Refunds: Set Up Fees below.) I also\nunderstand and agree that a \u003Cstrong\u003ENon-refundable\nDeposit equal to at least 50% of the Total Invoice of the website or\nproject \u003C\/strong\u003Ewill be required \u003Cstrong\u003Ebefore\u003C\/strong\u003E\nRockbridge can provision server hosting, domain name setup and \/ or\nstart work on the design of my website. \u003Cstrong\u003E\nNote:\u003C\/strong\u003E Our \u0022Website Creator\nSeries\u0022 does NOT require setup fees as they are complete Do-It-Yourself\n(D-I-Y) websites using only simple standard templates.\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong style=\u0022text-decoration: underline;\u0022\u003EREFUNDS\u003C\/strong\u003E\u003Cstrong\n style=\u0022text-decoration: underline;\u0022\u003E: WEBSITE DESIGN\n\/ INSTALLATION \/ PROJECT FEES\u003C\/strong\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003EI understand and agree \u003C\/strong\u003Ethat\nif I should change my mind or decide to cancel my purchase for any\nreason after providing Rockbridge the go ahead to build my website, as\nindicated by the issuance of my deposit, it must be done so in writing.\nAll projects are subject to a 50% non-refundable deposit of the total\nproject cost. \u003Cstrong\u003E This\nlimited refund policy is required to cover the design, web server\nprogramming, provisioning, labor and setup costs which Rockbridge\nincurs after I have given Rockbridge approval to go ahead and provision\nservers, designers and any specialty contractors to build my website\nupon the receipt of my deposit.\u003C\/strong\u003E\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EREFUNDS: MONTHLY\n\/ ANNUAL SUPPORT AGREEMENT BILLING\u003C\/span\u003E\n\u003C\/strong\u003E\u003Cbr\u003E\n\u003Cstrong\u003E I understand and agree \u003C\/strong\u003Ethat\nRECURRING monthly website support payments can only be canceled by me\nin writing. \u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EI may only cancel\nafter my first initial 12 months has elapsed\u003C\/span\u003E.\n\u003C\/strong\u003EServer hosting, domain\nnames, support and set up fees are not the responsibility of\nRockbridge. All ongoing support plans are based on Annual Renewal terms\n(although we can invoice monthly if you prefer). All monthly and annual\nrecurring billing is for a 12 month minimum commitment regardless of my\npayment plan.\u003Cstrong\u003E \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003E Rockbridge will\ninclude \u003Cu\u003Eprice protection for 3\nyears \u003C\/u\u003Eon all my Monthly and\nAnnual Support Plans.\u003C\/span\u003E\n\u003C\/strong\u003E\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003EIn summary, I understand\nthat Monthly, Quarterly or Annual Support Plan renewals can be canceled\nonly in writing and only after \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003Ethe first 12\nmonths\u003C\/span\u003E of service have\nelapsed and payment for a full year has been rendered. \u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003ENo retroactive\nrefunds are permitted for hosting and support plans\u003C\/span\u003E.\u003C\/strong\u003E\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cbr\u003E\n\u003Cstrong\u003E\u003Cspan\n style=\u0022text-decoration: underline;\u0022\u003EIMPORTANT: POST\nDESIGN WEBSITE SUPPORT SERVICES\u00a0WITHOUT A ROCKBRIDGE SUPPORT\nSERVICE AGREEMENT:\u003C\/span\u003E\u00a0\u003C\/strong\u003E\n\u00a0I understand that I either have, or am required, to purchase\nserver hosting services supporting WordPress from a thrid party in\norder to host the website designed by Rockbridge. These services must\nbe purchased separately from a website hosting company that fully\nsupports the WordPress Content Management Software.
